GENERAL TERMS AND CONDITIONS OF THE USE OF ELECTRONIC PRODUCTS (IMAGES, VIDEOS, AUDIO PRODUCTS) OF MRL

All products of Mirellibel LLC (hereinafter referred to as MRL) are protected by the laws of the Republic of Estonia and international agreements, and their reproduction, storage, delivery and/or analogization-digitalization without written permit of MRL is prohibited. Contract between MRL and User shall be deemed a written permit allowing the User to publish the images, videos and audio files of the digital archive of MRL.

Images, videos and audio files published by the User shall remain a property of MRL and/or corresponding image producer.

At the request of MRL, User is obliged to adhere to the contractual requirements at the publication of various electronic products (images, videos, audio, etc.).

User shall oblige to indicate the authorship of the published images according to the procedure provided by the Contract and to add a notice about the copyright of the images in the products (including in the issue). This notice should also include the source(s) of the images.

MRL shall bear no responsibility for the illegal use of the objects under copyright by the third parties and shall not oblige to compensate any expenses arising from the disputes concerning the copyright. In the case the User is aware of the illegal use of these images, he/she is obliged to inform MRL about it.

User shall oblige to add a word „staging“ and/or „posed“ in the case the images or videos have a posed and/or fictional content. Processing the images in the archive is authorised only at a written consent by MRL which is the license agreement between MRL and User.

User is right to edit the images, videos and audio files, including to cut, minimise or maximise them and to publish them like that also in his/her own product(s). Editing the images, videos and audio files to any extent shall not exempt the User from the obligation of indicating the authorship on them according to the procedure provided by the Contract and shall not give the user the copyrights for the images, videos or audio files.

When using the images, User shall oblige to add the names of the owner and agency to the images (for example, clip.ee and/or name of the photographer).

User shall bear full responsibility, if he/she has damaged the interests of the third parties by using the image from MRL and the third parties have claims (for compensation) arising from this action.

User has no right to deliver the text information attached to the electronic products (including images) to the third parties for commercial purposes.

After the entry into the Contract, MRL shall allow the User the access to the digital archive at the web address www.clip.ee by the sending the necessary user name(s) and password(s) by e-mail.

Each high resolution image, video or audio file ordered by the User and forwarded to him/her shall be deemed sold (used) image for which MRL shall issue an invoice according to the agreed prices and/or price list.

In the case of misuse of the images, videos or audio files of MRL, MRL shall retain a right to apply immediately the rights arising from the law.
